In some jurisdictions, there is an aggravated category of the offense at a higher BAC level, such as 0.12%. A suspect can be charged with DUI, driving under the influence of Alcohol (sometimes referred to as DWI, OVI and OWI, driving or operating a motor vehicle while intoxicated) at those levels. While BrAC tests are not necessary to prove a defendant was under the influence, laws in most states require the jury to presume that he/she was under the influence if his breath Alcohol level is found and believed to be over 0.08 (grams of Alcohol/210 liters breath) when driving.
